BUREAU FOR THE EMPOWERMENT OF ARBITRATION AND MEDIATION
BEAM ADR is a Non-profit organisation based in India . It was started by like minded ADR enthusiasts with the motto of contributing their best to the development of ADR in second tier cities of India. Author is the Managing Trustee spearheading its operation and women empowerment as the goal of her lifetime.
Propagate and popularise the idea of ADR / Mediation in disputes arising in domestic and international trade among business entities and trading parties and encourage the use of Mediation and ADR clauses in internal and international business and trade contracts.
Resolve issues via ADR and/or arrange for Mediation through its constituent members or otherwise in business and trade disputes of Domestic as well as International character, involving Indian or foreign parties including Governments and Public Sector undertakings and maintain panels of persons to act as Mediators and ADR professionals; Promote and bring about amicable settlement of disputes arising in the course of Domestic and International business and trade by Mediation or otherwise.
Ascertain the problems and requirements in respect of ADR and assess the need for additional facilities and for the purpose of corresponding with different organizations in India and abroad offering international ADR facilities.
Collaborate with international organizations and foreign ADR bodies on matters affecting international commercial ADRs and send delegations abroad and invite representatives of such organizations and bodies for the purpose.
Disseminate information and educational material concerning ADR process and laws, rules or procedures, techniques and facilities, international conventions, etc. on ADR matters;
Make a study of and assist in the improvement of legislation on ADR laws and procedures.
Draw up standard ADR/Mediation clauses, model rules of ADR/ar procedure, Mediation, etc.
Study the ADR/ Mediation rules and procedures of bodies dealing with ADR/ Mediation in India and suggest ways and means for overcoming any difficulties experienced by the trade;
Prepare, print and publish in papers, periodicals, pamphlets, bulletins and brochures, information concerning ADR/Mediation facilities existing in India and abroad and other useful material in furtherance of the subject of the trust;
Conduct research on different aspects of ADR/ Mediation theory and practice and to publish reviews specializing in the study of problems of ADR/Mediation.
Appoint trainees or investigators to study in India or abroad problems, methods and techniques in regard to ADR/ Mediation.
Offer facilities for the training of personnel in the techniques of ADR/ Mediation, offer and arrange for fellowships, furnish experts competent to advise on ADR/ Mediation legislation and procedures, organise seminars and study groups, on legal and practical problems relating to ADR/ Mediation legislation and procedures and organize courses and lectures on topical questions concerning ADR/ Mediation;
Publish ADR/Mediation settlement Agreement and judicial decisions pertaining to ADR/Mediation, research data and studies of projects undertaken in India or foreign countries on Mediation matters;
Furnish names of persons; suitable for appointment as Mediators and publish information concerning fees charged by various ADR/ Mediation procedures.
Promote ADR/ Mediation service agreements between India and other countries containing a provision for the adoption of joint clauses on ADR/ Mediation procedures.
Establish and maintain a reference library in pursuance of the objects of the Trust with reading and writing rooms and furnish the same with books, reviews, magazines, newspapers and other publications on ADR/ Mediation matters.
Convene conferences at such places and such times as may be determined in furtherance of the objects of the Trust;
Prepare list of recognized surveyors in collaboration with concerned organizations in India and abroad to facilitate survey and inspection in connection with ADR/ Mediation.
